Terms of Service

1. Scope of Services

Kinsky Balearics provides independent commercial advisory, business intelligence and owner-representation services. All services are provided on the basis of specific engagement terms agreed with the client.

2. Mallorca Business Reality Check

The Mallorca Business Reality Check is a structured independent commercial assessment priced at €1,500 plus applicable VAT. It covers one defined business decision and includes a confidential briefing, working session and written Decision Memo.

The Reality Check constitutes an entrepreneurial and commercial assessment. It does not constitute legal advice, tax advice, regulated investment advice, financial audit, formal valuation, technical due diligence or architectural advice.

3. Payment Terms

Payment for the Mallorca Business Reality Check is required in full at the time of booking. Payment is processed securely via Stripe. VAT is applied where required by the applicable tax jurisdiction.

4. Cancellation and Refunds

Given the nature of the engagement, cancellations and refunds are handled on a case-by-case basis. If you have concerns about the suitability of the service, a preliminary conversation before booking is recommended.

5. Confidentiality

Information shared during an engagement is treated as confidential and handled in accordance with the agreed engagement terms and applicable privacy obligations. Kinsky Balearics does not use client names or confidential engagement details as marketing material.

6. Independence and Conflicts of Interest

Kinsky Balearics operates independently from the vendors, agents, professionals and other parties involved in the client’s situation. Where any referral fee, commission or commercial relationship could create a relevant conflict of interest, it will be disclosed transparently where appropriate or legally required.

7. Limitation of Liability

Kinsky Balearics provides assessments and recommendations based on the information available at the time of the engagement. Liability is limited to the fee paid for the specific engagement. Kinsky Balearics does not accept liability for decisions made by the client based on the assessments provided.

8. Intellectual Property

All written deliverables (including Decision Memos) are provided for the client’s use in connection with the assessed decision. Redistribution, publication or commercial use of these materials without prior written consent is not permitted.

9. Governing Law

These terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Balearic Islands, Spain.
